A 40-year-old Cheyenne man who was serving a 45-day sentence for two misdemeanor drug possession charges is now facing eight felony drug charges.
Search Warrant
According to a booking sheet, on Monday, July 28, a search warrant was executed at Anthony Michael Hernandez Sr.’s home in the 300 block of East 5th Street.
According to police, Hernandez had less than three grams of suspected methamphetamine and fentanyl in his possession when the search warrant was served.
Hernandez was then arrested and booked into the Laramie County Detention Center for the charges.
Eight Felony Charges
On Tuesday, August 5, Hernandez appeared in Laramie County Circuit Court before Magistrate Caitlin Harper on eight felony counts, including four for conspiracy and four for possession of fentanyl with intent to deliver, each punishable by up to 20 years in prison, a $25,000 fine, or both.
Hernandez allegedly conspired with a confidential informant to deliver fentanyl on or around April 19, May 28, and June 18.
It is also claimed that between April 20 and July 26, Hernandez conspired with another person, including but not limited to Jesse Hernandez, to deliver fentanyl.
Bond Set at $25K Cash
Harper accepted the state’s recommendation and set Hernandez’s bond at $25,000 cash.
“Obviously, you’re serving a sentence,” Harper told Hernandez. “If you can post $25,000 cash or that amount is lowered at your preliminary hearing here in 10 days, the court will discuss bond conditions at that time.”
Hernandez’s preliminary hearing is scheduled for Friday, August 15 at 9 a.m.
Remember that all defendants are presumed innocent unless proven guilty beyond a reasonable doubt.
