Mills man sentenced to prison for repeat shoplifting

CASPER, Wyo. — A Mills resident received a prison sentence on Wednesday for stealing a fifth of Hornitos Tequila Silver from a Casper liquor store in November.

A fifth or subsequent offense of petty theft can be charged as a 10-year felony beginning July 1, 2023.

Chief Deputy District Attorney Blaine Nelson informed Judge Dan Forgey that the plea deal for the defendant, Francisco Michael Sosa, was invalid because Sosa was arrested for attempting to shoplift a bottle of whiskey just 30 hours after being released on a bond reduction in the Tequila Bottle case.

“Your Honor, stealing is wrong, in and of itself,” he replied. He noted that Sosa’s statements during the presentence investigation revealed no remorse or reflection on his previous actions.

“I messed up,” Sosa told Judge Forgey when it was his turn to speak. His public defender, Dylan Rosalez, stated that this was Sosa’s first felony, and that a prison sentence outweighed the behavior.

Nelson stated that Sosa’s record was “replete” with petty theft and controlled substance misdemeanors, and that a prison sentence was required to put an end to his criminal behavior.

Forgey ultimately imposed a prison sentence ranging from two to six years, citing the history and new allegations as justification.

Sosa will receive credit for 169 days served. He has also been ordered to pay $21.99 in restitution for the tequila.
